Welcome to PlateScribe.

These Terms of Service ("Terms") govern your access to and use of the PlateScribe mobile application, website at https://platescribe.com, and related services (collectively, the "Services").

PlateScribe is operated by Benjamin D Chan, a sole proprietor ("PlateScribe," "we," "us," or "our").

Please read these Terms carefully before using the Services.

By creating an account, accessing, or using PlateScribe, you agree to these Terms. If you do not agree, do not use the Services.

1. Description of the Services

PlateScribe is an AI-assisted nutrition-tracking application.

Its features may include:

We may modify, improve, suspend, or discontinue features from time to time, subject to applicable law and any obligations associated with paid subscriptions.

We do not guarantee that every feature will remain available indefinitely.

2. Eligibility and Accounts

You must be legally capable of agreeing to these Terms or have the permission of a parent or legal guardian where required by applicable law.

PlateScribe is not intended for children under 13.

When creating an account, you agree to provide accurate information and maintain the security of your login credentials.

You are responsible for activities conducted through your account, except to the extent resulting from circumstances for which you are not legally responsible.

You agree to notify us promptly if you believe your account has been compromised.

We may restrict or suspend access where reasonably necessary to address security threats, fraudulent activity, unlawful conduct, or material violations of these Terms.

3. AI-Generated Nutrition Estimates

PlateScribe provides estimates, not guaranteed nutritional measurements.

The application uses artificial intelligence to analyze meal photographs and estimate calories and macronutrients.

Actual nutritional values can vary significantly based on:

You are responsible for reviewing estimates and making corrections where appropriate.

We do not guarantee the accuracy, completeness, or suitability of any nutritional estimate.

4. Not Medical or Professional Advice

PlateScribe is not a medical device or medical service.

The Services are provided for general informational and personal nutrition-tracking purposes.

PlateScribe does not provide medical diagnosis, treatment, or individualized medical advice.

Information generated by the application should not replace guidance from qualified healthcare professionals, including physicians and registered dietitians.

Do not rely on PlateScribe to determine:

If you have a medical condition, food allergy, or specialized nutritional requirement, consult an appropriately qualified professional.

In a medical emergency, seek appropriate emergency assistance.

5. Artificial Intelligence Processing

PlateScribe uses OpenAI technology to assist with meal analysis.

When you choose to analyze a meal photograph, the selected photograph and related meal-source information are transmitted through PlateScribe's backend for AI processing.

The application requests your consent before your first AI meal analysis.

You may decline that processing by choosing not to proceed with analysis.

AI-generated outputs are automated estimates and should be reviewed rather than treated as verified facts.

6. User Content

"User Content" includes photographs, meal information, corrections, and other content you provide through the Services.

You retain any ownership rights you have in your User Content.

You grant PlateScribe a limited, nonexclusive license to host, store, reproduce, process, transmit, and display your User Content solely as reasonably necessary to:

This permission ends when the relevant content is deleted from our active systems, except to the extent continued processing or retention is legally permitted or necessary under our Privacy Policy.

You represent that you have the necessary rights or permissions to upload the content you submit.

You agree not to upload unlawful content or content that violates the rights of others.

We do not claim ownership of your personal meal photographs.

7. Acceptable Use

You agree not to:

  1. Use PlateScribe for unlawful purposes.
  2. Attempt to gain unauthorized access to another user's account or information.
  3. Interfere with the Services or their infrastructure.
  4. Circumvent authentication, security, or subscription access controls.
  5. Use automated systems to abuse the Services or overwhelm our infrastructure.
  6. Upload malicious code or content intended to compromise the Services.
  7. Reverse engineer or misuse the Services in violation of applicable law or these Terms.
  8. Resell access to the Services without authorization.
  9. Use the Services in a way that infringes the rights of others.

We may take reasonable action to prevent abuse, protect users, and maintain service availability.

8. Free Features and Usage Limits

PlateScribe may offer certain features without payment, subject to usage limits.

Free usage allowances may include a limited number of AI meal analyses.

We may change free-tier limits or the availability of free features prospectively, subject to applicable law.

Attempting to bypass free-tier limits or subscription restrictions is prohibited.

Free access does not guarantee unlimited or uninterrupted use of AI processing services.

9. Premium Subscriptions

PlateScribe may offer premium functionality through an automatically renewing subscription purchased using Apple's App Store.

9.1 Subscription Pricing

The applicable price, billing period, and any available promotional offer are displayed before you confirm a purchase.

Your purchase is subject to the price and terms shown in Apple's purchase interface.

Prices may vary by region, currency, taxes, or applicable promotional offers.

9.2 Automatic Renewal

Subscriptions automatically renew unless canceled before the applicable renewal deadline.

Apple generally requires cancellation at least 24 hours before the end of the current subscription period to avoid the next renewal.

Payment is charged through your Apple Account.

The subscription continues for successive billing periods unless canceled or otherwise terminated under Apple's applicable rules.

9.3 Managing and Canceling Subscriptions

You can manage or cancel your subscription through your Apple Account.

Canceling a subscription ordinarily stops future automatic renewals. Access to paid features may continue until the end of the already-paid subscription period, subject to Apple's applicable terms.

Deleting the PlateScribe app from your device does not cancel your subscription.

Deleting your PlateScribe account does not cancel your subscription.

You must cancel through Apple separately to prevent future renewal charges.

9.4 Refunds

Purchases and subscription payments made through Apple's App Store are handled under Apple's applicable billing and refund policies.

PlateScribe does not directly process App Store subscription refunds.

You may request a refund through Apple:

Refund eligibility and decisions are determined by Apple in accordance with applicable policies and law.

Nothing in these Terms limits any refund rights you may have under applicable consumer-protection law.

9.5 Subscription Changes

We may offer different subscription products or modify subscription pricing in the future.

Any changes will be handled through applicable App Store procedures, including required notices or consent.

We will not unilaterally alter an existing Apple subscription outside the mechanisms permitted by Apple and applicable law.

9.6 Subscription Verification

PlateScribe uses RevenueCat to manage subscription entitlements and determine access to premium features.

Subscription information may be associated with your PlateScribe account identifier.

Access to premium functionality may depend on successful verification of an active entitlement.

10. Account Deletion

You may delete your PlateScribe account using the Delete Account function in the application's Profile/Settings section.

Successful deletion is intended to permanently remove your PlateScribe account and saved meal history from our active application systems.

This process may include:

Account deletion cannot ordinarily be undone.

Information may remain temporarily in backups, security logs, or third-party systems in accordance with applicable retention policies and legal obligations.

Apple and RevenueCat may retain subscription and transaction information independently of your PlateScribe account. RevenueCat may also retain customer identifiers and activity records, including records associated with users who have not purchased a subscription. These records are not automatically deleted when you delete your PlateScribe account. Additional information about retention and privacy requests is provided in our Privacy Policy.

Account deletion does not automatically cancel any active Apple subscription.

11. Availability and Changes to the Services

We strive to provide reliable Services but cannot guarantee uninterrupted availability.

Access may be interrupted by:

We may update or modify the Services to improve functionality, security, or compliance.

Where changes materially affect paid functionality, we will comply with applicable contractual and legal obligations.

12. Intellectual Property

PlateScribe's software, branding, design, text, graphics, and other original materials are owned by PlateScribe or its licensors, except for User Content and third-party materials.

We grant you a limited, personal, nonexclusive, nontransferable, revocable license to use the application for its intended purposes, subject to these Terms and applicable law.

This license does not transfer ownership of the application or its underlying intellectual property.

You may not reproduce, distribute, sell, or commercially exploit our proprietary materials without permission, except where allowed by applicable law.

13. Privacy and Data Protection

Your use of PlateScribe is also governed by our Privacy Policy:

The Privacy Policy explains how information is collected, processed, stored, disclosed, and deleted.

We use third-party providers, including Supabase, OpenAI, RevenueCat, Apple, and Render, to deliver the Services.

Their processing practices may also be governed by their own applicable terms and policies.

14. Disclaimers

To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.

We do not guarantee that:

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

15. Limitation of Liability

To the maximum extent permitted by applicable law, PlateScribe and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of the Services.

This may include losses arising from inaccurate nutritional estimates, interruptions, or inability to access the Services, except where liability cannot lawfully be limited.

To the extent permitted by law, our aggregate liability for claims arising from the Services will not exceed the greater of:

These limitations do not apply where prohibited by law, including where applicable law does not permit limitation of liability for fraud, willful misconduct, gross negligence, or other protected claims.

16. Termination and Suspension

You may stop using PlateScribe at any time.

You may also delete your account through the application.

We may suspend or terminate access if reasonably necessary because of:

Where appropriate and reasonably practicable, we may provide notice before suspension or termination.

Termination does not automatically cancel an Apple subscription. Subscription cancellation must be handled through Apple.

Provisions that by their nature should survive termination, including applicable payment obligations, intellectual property protections, disclaimers, and liability limitations, may continue to apply.

17. Third-Party Services

PlateScribe relies on third-party technologies and services.

We are not responsible for independent third-party services outside our control, subject to applicable law.

Your use of Apple's App Store and other third-party services may be subject to their separate terms.

If there is a conflict between these Terms and mandatory App Store purchase rules, the applicable mandatory rules govern the relevant transaction.

18. Changes to These Terms

We may update these Terms to reflect changes in our Services, legal requirements, or business practices.

We will update the Last Updated date when changes are made.

If changes materially affect your rights, we will provide notice where required by law.

Any additional consent required by applicable law will be obtained before the relevant changes take effect.

Your continued use after updated Terms take effect may constitute acceptance to the extent permitted by law.

If you disagree with updated Terms, you may stop using the Services and delete your account, subject to any separately managed subscription obligations.

19. Applicable Law

These Terms are governed by applicable laws of the United States and any other mandatory laws that apply to your use of the Services.

Nothing in these Terms deprives you of consumer protections or other rights that cannot be waived under applicable law.

20. Apple-Specific Terms

The following provisions apply when you obtain PlateScribe through Apple's App Store.

  1. These Terms are between you and PlateScribe, not Apple. PlateScribe is responsible for the application and its content, subject to applicable law.
  2. Your license to use the application is limited to a nontransferable license on Apple-branded products you own or control, as permitted by the Apple Media Services Terms and applicable usage rules, including applicable Family Sharing arrangements.
  3. Apple has no obligation to provide maintenance or support services for PlateScribe.
  4. To the extent permitted by applicable law, Apple is not responsible for claims relating to the application, including product liability, regulatory compliance, or consumer-protection claims.
  5. PlateScribe, not Apple, is responsible for addressing claims that the application infringes third-party intellectual property rights, to the extent required by applicable law.
  6. If the application fails to conform to an applicable warranty, you may notify Apple. Apple may refund the purchase price, if any, in accordance with its applicable obligations. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the application.
  7. You represent that you are not located in a country subject to a U.S. government embargo or designated by the U.S. government as a terrorism-supporting country, and that you are not listed on a U.S. government prohibited or restricted-party list.
  8. You agree to comply with applicable third-party terms when using the application.
  9. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable Apple-specific provisions against you.
